Privacy Policy (Malay version)

SEDC Energy Sdn Bhd (“SEDCE”) Personal Data Notice (pursuant to Section 7(1) Personal Data Protection Act 2010)

SEDCE is committed to comply with the applicable regulations, guidelines, orders made under the Personal Data Protection Act 2010 and any statutory amendments or re-enactments made thereto, including the Personal Data Protection (Amendment) Act 2024 (collectively, “PDPA”), which regulates the processing of personal data in commercial transactions.

 

This Personal Data Notice applies to any person whose personal data is being processed by SEDCE or on behalf of SEDCE. This Personal Data Notice serves to inform you how your personal data is being processed by SEDCE when you interact with SEDCE in person, as a user of the KAMEK mobile application (“KAMEK App”), as a member of the KAMEK Loyalty Programme, or as a visitor to SEDCE’s website and social media platforms, such as Facebook and LinkedIn (collectively “Official Channel”).

Purposes

SEDCE may process your personal data for the following purposes (collectively “Purposes”):

  • Providing our products and delivering our services to you;

  • Managing relationships and marketing activities such as maintaining and promoting contact with you as well as sending you newsletters, event invitations, promotions, offers, surveys, and other marketing communications;

  • Managing your account including your use of our KAMEK App, account verification and login processes (that is, ensuring that only you or someone you have authorized can access your account and information);

  • Designing, customising or personalizing promotions, loyalty rewards, membership benefits or events for you;

  • Enhancing customer service and developing or improving of our products and services;

  • Performing and analysing market surveys and marketing strategies;

  • Managing and administering promotions, contests and the KAMEK Loyalty Programme offered to SEDCE’s customers, including point tracking, point redemption, membership benefits and offering you digital rewards to recognise you as a valued customer; or

  • Detecting or preventing fraud if you use a mobile payment function to purchase SEDCE’s products;

  • Ensuring the security and safety at PETROS multifuel stations, convenience stores and quick serve restaurants (collectively, “Premises”), including monitoring via video surveillance (“CCTV”);

  • Storing, deleting or anonymising your personal data;

  • Conducting audits, investigations, dispute resolution or insurance purposes, litigation or defence of claims;

  • Performing statistical, historical or scientific research;

  • Managing cookies and similar technologies to improve your browsing experience and analyse website and app traffic;

  • Ensuring legal and/or regulatory compliance; or

  • As otherwise informed to you from time to time.

Source of Data Collection

Your personal data is collected from various sources, including information you have provided us, information from third parties and information in the public domain, including but not limited to the following:

  • Through your submission for registering an account and membership;

  • Through your participation in the KAMEK Loyalty Programme, surveys, contests, campaigns, events or promotional activities;

  • Through your voluntary verbal or written enquiries, complaints, requests or communication with or to us;

  • Through your visit to the Premises or attendance to promotional or other marketing events organised by us, including video surveillance, camera or video images captured for security or promotional purposes; 

  • Through your interaction with one of our digital advertisements through the KAMEK App or our Official Channel;

  • Through cookies and similar technologies on the KAMEK App, our website and other internet platforms;

  • From such other sources in respect of which you have given your consent to disclose information relating to you and/or where not otherwise restricted; and

  • Any other information that is supplied and/or collected when you use the KAMEK App, our Official Channel and other internet platforms.

Types of Data Collection

Your personal data that we may collect includes but is not limited to the following:

  • Your personal identification details such as name, identification card/passport number, age, birth date, race, address, gender, occupation, contact numbers and email address;

  • Your account information for access to the KAMEK App, our Official Channel and other internet platforms such as your login ID, email address, screen name, encrypted password and security question and answer;

  • Your participation in the KAMEK Loyalty Programme via the KAMEK App including accumulated points, points validity, the redemption activity and transaction history;

  • Your image by way of CCTV footage from the Premises as part of our security infrastructure;

  • Your image captured by camera or video when you attend any campaigns, or events held at the Premises or otherwise organized by us, or captured as part of a promotional contest or other marketing activities;

  • Your feedback that you voluntarily share with us about your experience of using our products and services;

  • Any content, such as photos, videos, personal stories or other similar media or content that you create and share with us on third party social media platforms or by uploading it to the KAMEK App or our Official Channel;

  • Any information that you share publicly on a third party social media platforms or information that is part of your profile on a third party social media platforms and that you allow the third party social media platforms to share with us, such as your basic account information (e.g. name, email address, gender, birthday, current city, profile picture, user ID, list of friends, etc.) and any other additional information or activities that you permit the third party social media platforms to share;

  • Information automatically collected when you visit our Official Channel such as IP address, browser type, device information, usage activity and online identifiers to enable ‘cookies’ and similar technologies; or

  • Any information that we need in order to fulfil an order, or that you use to make a purchase, such as your debit or credit card details (cardholder name, card number, expiration date, etc.) or other forms of payment (if such are made available).

Children’s Personal Data

We do not intentionally collect personal data of individuals under 18 years old, unless for educational or marketing events specifically targeting children. If you are under 18 years old, please do not submit any personal data, such as your name, address or email address, without the consent of your parent or guardian. If you wish to interact with us in a manner requiring personal data submission (e.g. for education or marketing events), please have your parent or guardian to submit the data on your behalf.

Rights of the Data Subject

  • You undertake and warrant to SEDCE that your personal data is accurate, complete, not misleading and up-to-date. The onus is on you to update SEDCE if your personal data has changed. If you choose not to provide us with information set out above for the purposes of using or accessing to our KAMEK App, the KAMEK Loyalty Programme and our Official Channel, the only consequence is that it will affect your ability to fully interact with and utilise the KAMEK App, the KAMEK Loyalty Programme and our Official Channel.

  • You may access and request for correction or deletion of your personal data or withdraw your consent for us to process your personal data at any time.   • Before processing any request for access, correct, delete, enquiries or complaints, we may require you to verify your identity and/or provide additional information to enable us to respond appropriately. If you are under the age of 18 years, your parent or guardian may submit such requests on your behalf, subject to verification.

Security of Personal Data

  • SEDCE assures you that all personal data collected, stored, processed or used will be treated as confidential. We will implement the appropriate procedure and measures in order to protect your personal data and prevent the data from loss, misuse, unauthorised access, disclosure, alteration, or destruction. Measures may include encryption, authentication processes, secure servers and internal audits. 

  • You are responsible for maintaining the confidentiality of your login credentials and passwords. You must not to disclose the same to anyone at any time and under any circumstances, whether intentionally or unintentionally.

Retention of Personal Data

SEDCE shall retain your personal data from the date of collection for as long as it is necessary for the fulfilment of the Purposes or for compliance with the law or legal, or regulatory obligations by SEDCE. If you withdraw your consent, delete your KAMEK App account, or terminate your participation in the KAMEK Loyalty Programme, our personal data will be securely deleted or anonymised in accordance with our internal data retention policies, unless retention is required for legal or regulatory purposes.

Disclosure of Personal Data

Your personal data are exclusively processed for the purposes referred to above and will only be shared on a strict need-to-know basis with:

  • Other companies within the SEDCE group of companies, including to those which may be located outside of your location;

  • With your consent, authorized third party companies in co-operation with SEDCE that may supply products and/or services to users of the KAMEK App, members of the KAMEK Loyalty Programme, our Official Channel and other internet platforms;

  • Authorized service providers involved in mobile payments (such as PayPal, Apple Wallet or Android Pay) and/or authorised service providers involved in our website and other internet platforms;

  • Authorised agents, licensees, service providers, external auditors and/or subcontractors of SEDCE;

  • Public authority, government, regulatory, supervisory, investigative or fiscal agency where it is necessary to comply with a legal or regulatory obligation to which the relevant SEDCE company/companies is subject to or as permitted by applicable law; or

  • Any person to whom SEDCE proposes to assign or transfer any of its rights and/or duties.

Transfer of Personal Data

If required for any of the foregoing Purposes, your personal data may be transferred and stored to locations outside Malaysia or disclosed to our related corporations, business partners, to relevant authorised service provider or to third parties where it  is necessary for the fulfilment of the Purposes or for compliance with the law or legal, or regulatory obligations by SEDCE and/or as a result of any restructuring, sale or acquisition of any company within SEDCE, provided the recipient uses your personal information for the Purposes only, and/or service providers, who may be located within Malaysia or if outside of Malaysia, the receiving country has substantially similar personal data protection law and/or we will take steps to ensure that appropriate safeguards, required by law, are taken with the aim of ensuring that your personal data continue to be protected.

Cookies and Third-Party Social Media Platforms

  • Cookies and similar technologies are used on the KAMEK App and our website to improve your browsing experience and analyse traffic. You may manage cookies via your browser settings.

  • Please note that when you interact with us through any third-party social media platforms, your personal data may also be subjected to the private policies of those platforms. We encourage you to review their respective privacy policies.

Changes to SEDCE’s privacy policy and personal data notice

SEDCE reserves the right to update and amend this Personal Data Notice from time to time. SEDCE will notify you of any changes via announcement on SEDCE’s website or through other reasonable means of providing notice as SEDCE may deem appropriate. Any changes to this Personal Data Notice will be effective immediately upon notice to you and will be reflected in the “Last Reviewed Date” listed at the top of this Personal Data Notice. Your continued use of the KAMEK App and our Official Channel after such changes signifies your acceptance of the revised Personal Data Notice.
